For tax years beginning on or after January 1, Form CD-419 provides a 7-month extension to file the applicable North Carolina corporate tax return.
Filing Form CD-419 by the original due date prevents the failure-to-file penalty, but it does not prevent penalties or interest on any unpaid tax.
- Failure to File Penalty: 5% of the unpaid tax for each month, or part of a month, that the return is late, up to a maximum of 25% of the tax due (G.S. 105-236).
- Failure to Pay Penalty: A separate penalty applies to any tax not paid by the original due date, in addition to any failure-to-file penalty.
- Interest: Interest accrues on unpaid tax from the original due date until the tax is paid in full, at the rate set by the NCDOR Secretary of Revenue every six months under G.S. 105-241.21.
Both penalties and interest may apply even when a valid extension has been granted if the tax is not paid by the original due date.
Yes. A corporation that receives an automatic federal income tax extension is automatically granted a corresponding North Carolina extension. The corporation must certify on its North Carolina return that it received the federal extension. If the corporation does not receive an automatic federal extension, it can file Form CD-419 by the original North Carolina return due date to request an extension.
No. An extension gives you additional time to file the return, but it does not extend the time to pay taxes due. Tax not paid by the original due date may be subject to applicable penalties and interest.
