What is Form 1099-MISC?

Form 1099-MISC is used to report payments for services performed by individuals who are not treated as employees. Miscellaneous income includes payments made to subcontractors wages, rental payments, prizes, awards, or substitute payments in lieu of dividends. A 1099-MISC Form, reporting miscellaneous income, must be e-filed to the IRS and a copy must be sent to the recipient. Both forms must arrive by their respective deadlines.

Filing Criteria for Form 1099-MISC

You are responsible for Filing Form 1099-MISC if you fall under any one of the following categories:

  • If you paid at least $10 in royalties or broker payments in lieu of dividends or tax-exempt interest.
  • If you paid more than $600 for the year to someone whom you have paid during the year for rent, prizes and awards, medical and health care payments, and services performed by individuals (independent contractors) who are not your employees.
  • In addition, use the 1099-MISC form to report that you made direct sales of at least $5,000 of consumer products to a buyer for resale anywhere other than a permanent retail establishment.

Note: However, if a recipient works for multiple companies and earns a combined total of $600 he or she will not receive a 1099-MISC but will still be required to report income tax.

IRS requires Form 1099-MISC to be reported on or before January 31, 2020, when nonemployee compensation (NEC) payments are reported in box 7. For a 1099 MISC Form with the amount reported in box 8 (substitute payment in lieu of dividends or interests) or in box 14 (Gross proceeds paid to an attorney), the deadline is February 17, 2020.
